Recently, we have been observing the development of the decision-making practice of the Chief Pharmaceutical Inspector consisting in determining the loss of the guarantee of proper operation of a pharmacy due to incorrect – according to GIF – verification of the authenticity of requests issued by entities providing outpatient health services.
According to GIF, a pharmacist is obliged to refuse to meet the demand if:
(i) it was issued by entities providing only outpatient health services;
(ii) the scope of products indicated in the demand exceeds the list covered by the Regulation of the Minister of Health of 12 January 2011 on the list of medicinal products that may be supplied on an ad hoc basis in connection with the provided health service (Annex 1 to the Regulation).
This position raises numerous doubts and requires an in-depth analysis, considering the multifaceted nature of the functioning of the pharmaceutical market. Therefore, we would like to ask you to answer (YES / NO) the questions indicated in this questionnaire. The results of the study will allow to confront the position of the GIF with the practice of meeting the needs issued by entities providing outpatient health services, which will undoubtedly strengthen the quality of our legal analysis.
